NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN.
A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Sponsor: Deluxe Small Business Sales, Inc. 3680 Victoria Street North, Shoreview, MN 55126. This is a trade promotion and is not open to consumers.
The Project REV Contest (the “Contest”) offers small businesses the chance to win a suite of products & services from Deluxe Small Business Sales, Inc. to makeover and promote their business. In these rules “we” “our” and “us” refer to Deluxe Small Business Sales, Inc., the Sponsor of the Contest. “You” “yourself” “I” “me” and “my” refers to an eligible Contest Entrant.
ELIGIBILITY AND CONTEST PERIOD: The Contest is open only to small business entities that are legally domiciled in the 50 United States or the District of Colombia (excluding Puerto Rico) and are not part of a franchise organization (collectively, “Entrant” or “Entrants”). The Contest entry period begins August 1, 2011 at 12:00:01 a.m. Central Time (“CT”) and ends September 30, 2011 at 11:59:59 p.m. CT (“Contest Period”). Entries submitted outside the Contest Period will not be considered for participation in the Contest.
Entries must be submitted by an authorized representative of the business customer, i.e. owner, officer, or other authorized employee, 18 years of age or older at the time of entry (or 19, if representative is a resident of Alabama or Nebraska). The person named on the Contest Entry Form for the Submission will be deemed the entrant (“Entrant”). Neither an owner, officer nor employee of the business customer is eligible to enter on his or her own behalf. Only the business entity is eligible for prize award. If a group of individuals elects to collaborate on an Entry, they are required to designate one (1) representative to enter the Contest and accept the prize on behalf of the group. Neither Sponsor nor any of its agents or affiliates is liable for disputes between collaborators related to an Entry. Officers, directors, agents, employees and/or contractors of Deluxe, its affiliates and its “Promotional Participant,” i.e. SCORE and each of its and their immediate family members and/or those living in the same household of each are not eligible to enter or win. By entering into the Contest, Entrants warrant that they are eligible to participate, agree to be bound by these Official Rules and by the decisions of the Sponsor. Limit one (1) entry per small business entity.
PRIZE: The Prize award for Project REV is approximately $15,000 worth of customized marketing and promotional products and services from Deluxe Small Business Sales, Inc. (approximate retail value $15,000). The prize value may be more or less depending on the nature and marketing needs of the winning business. Up to ten (10) prizes will be awarded. Limit one prize per Winner. Customized Prizes include:
- Marketing plan consultation and development
- Web site design, hosting
- Search engine marketing
- E-mail marketing
- Promotional products
- Logo design
- Print marketing
- Market research insight
- Public relations support
- Social media support
For subscription services, Winners will have the option to extend the service after the Mentorship Period. In the event of the unavailability of one or more of Sponsor’s products or services included in a Prize, Sponsor reserves the right to substitute similar Prize of equal or greater value. Awards consist of only the items specifically listed as part of the Prize. Prize is not transferable, assignable, redeemable, or exchangeable for cash and is subject to all terms and conditions of use as established by the Sponsor. All federal, state and local income and/or gift taxes regarding a Prize aware are the responsibility of each Winner.
SELECTION OF WINNERS / ODDS OF WINNING: There will be up to 10 Winners selected from among all eligible Entrants. Winners will be selected by a panel of Judges appointed by the Sponsor who are skilled in the areas of marketing and communications. Following is an example of the judging criteria that will be used in the selection of Winners (1) the application, viability of Deluxe’s marketing products and services to the winning business; (2) suitability of the Winner’s business needs to the Prize awarded and Sponsor’s Contest Goals; and (3) Winner’s Commitment to Participate as defined below, (4) geographic disparity of Eligible entrants; and (5) the disparity in the nature of the business of Eligible Entrants.
Odds of winning depend, in part, on the number of eligible entries received during the Contest Period and on the viability of Winners vis-à-vis the judging criteria, the Sponsor’s Contest Goals and their Commitment to Participate. Winners will be notified by mail, email or phone using the information supplied in the Entry Materials. Return of any selection notification as undeliverable may result in disqualification and selection of an alternate Winner. Winners’ business must be operating at the time of selection. Winners may be disqualified, even after they have been notified as a Prize Winner if the business entity and/or its authorized representative is deemed ineligible or fails to satisfy all requirements as set forth in the rules, or the business becomes inoperable during the Mentorship Period,. Decisions of the Sponsor are final. Limit one (1) Winner per small business entity.
COMMITMENT TO PARTICIPATE: Winners must agree to commit to Project REV for a term of thirteen months from the date of application of Deluxe’s products and services to their business (“Mentorship Period”). Winner’s participation during the Mentorship Period may include, but is not limited to, (i) marketing consultation by the Sponsor or its agents; (ii) the testing of a customized marketing plan for up to one year; (iii) participation in Sponsor’s focus groups and/or product testing; (iv) participation in up to three panel discussions or keynote addresses sponsored by Deluxe; (v) participation in media interviews; (vi) sharing of monthly revenue results.
Deluxe will reimburse Winners for reasonable and customary travel and expenses relating to their Commitment to Participate in Project REV. All such expenses must be approved by Deluxe in advance of being incurred.
SPONSOR’S CONTEST GOALS: are to (1) demonstrate the viability and return on investment (“ROI”) of its marketing products and services as applied to a Contest Winner (a business that needs the website and/or marketing, branding and promotional services offered by Deluxe); and (2) measure ROI by monitoring and publishing the Winner’s demonstrated successes in using Deluxe’s products and services over the course of one year from their application to the business.
In order to measure ROI and a Winner’s demonstrated successes Winners may be required to disclose unpublished financial information to Sponsor. All such information shall be treated as confidential information and protected from disclosure using reasonable measures of security which shall not be less than the measures of security Sponsor uses to protect its own confidential information.
HOW TO ENTER (NO PURCHASE NECESSARY): Visit www.projectrev.com (the “Site”) during the Contest Period, complete the official entry form by providing all of the requested contact information and submit together with any other supporting materials (collectively, “Entry Materials”). LIMIT ONE ENTRY PER BUSINESS. Incomplete entries and entries received outside the Contest Period will not be considered.
Content & Technical Requirements for Entry Materials:
- Do not use the Deluxe brands or logos except by displaying Deluxe products;
- Any elements in your Entry Materials, including without limitation, references to companies, brands or logos other than Deluxe, music, audio, speech, voiceovers, video stills, visuals or other audiovisual materials used must be
- entirely original and created and performed by you, or be in the public domain
- use of any elements, including without limitation music, audio, speech, voiceovers, video, stills, visuals or other audiovisual materials that are not original or in the public domain may result in disqualification of an Entrant, in Sponsor’s sole discretion;
- For Entry Materials that include an uploaded video:
- the video must not be more than three (3) minutes in length;
- the file size must not be larger than 30 MB; and
- the file format must be either .mov or .wmv
- NOTE: once you submit, upload and register your Entry Materials in the Contest, your submission is final and may not be modified or edited by you. Entries and Entry Materials will not be returned.
CONDITIONS OF ENTRY: As a condition of entry into this Contest entrants agree to submit to a background and credit check. Also, by uploading and submitting Entry Materials, Entrants warrant and represent that the submission (i) is original and is owned by the Entrant, including, without limitation, the copyrights in the recording and the performance contained therein, (ii) contains all necessary rights and permissions from persons other than the Entrant who are included in the Entry Materials (note that if the likeness of a minor is included, such grant of rights must include written permission from the minor’s parent or legal guardian authorizing the use of the minor’s likeness on behalf of the minor); and (iii) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party. Sponsor’s determination as to whether the Submission potentially violates the rights of any third party is final.
HOW ENTRIES MAY BE USED: Subject to Sponsor’s general Terms and Conditions and Privacy Policy posted on the Site, Contest entries and all submitted materials become the sole property of Sponsor and will not be returned. Your entry into this Contest constitutes your consent to participate in the Contest, abide by these Official Rules and the Sponsor’s terms of use and privacy policy and your consent for the Sponsor to obtain, use and transfer your name, address and other information for the purpose of administering and promoting the Contest. In addition, by entering the Contest, Entrants consent to be contacted by and receive marketing communications from the Sponsor.
PUBLICITY, USE OF NAME AND LIKENESS: Winners through their authorized representatives must sign and return an Affidavit of Eligibility and Release of Liability/Publicity Release Form within seven (7) days of notification that they have won a Prize. Noncompliance may result in disqualification and the selection of an alternate Winner. Except where prohibited by law, entry in the Contest constitutes Entrant’s consent to Sponsor’s use of the Entrant’s name, city and state of business location; the name, city and state of residence of the authorized person submitting the entry for the small business; the entry and all submitted materials, and the likeness, photograph, and image of the Entrant and person submitting the entry for advertising, publicity, and promotional purposes in any media, online or offline, without further permission, consent, payment or other consideration except where prohibited by law.
Entrants hereby grant the Sponsor an irrevocable, royalty-free, worldwide right and license to (a) use, review and assess all Entry Materials in connection with this Contest; and (b) feature your entry and all its content into collateral materials developed in connection with the promotion of this Contest in all media now known or later developed (collectively the “Licensed Rights”); and you agree to sign any necessary documentation that may be required for us or our designees to make use of or enforce the Licensed Rights. Notwithstanding, we are not obligated to use your entry for any purpose, even if it is selected as a prize-winning entry. Entrants waive intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor’s use of the Entry Materials, and agree not to sue or assert any claim against the Sponsor and/or its subsidiaries, agents or affiliates for the use of the Entry Materials or Entrant’s likeness or statements.
GENERAL RULES: CONTEST IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW and is subject to applicable federal, state and local laws and regulations. The Sponsor is not responsible for lost, late, damaged, delayed, incomplete, unintelligible applications or applications not received by the application deadline, or interrupted or unavailable network, server or other connections, miscommunications, failed telephone, computer hardware or software, and other technical errors or failures of any kind, including any injury or damage to any person’s computer related to or resulting from participating in or experiencing any materials in connection with the Project; unauthorized human intervention; failed, incomplete, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, that may limit a user’s ability to participate in the Project, including without limitation, the incorrect or inaccurate capture of application information online regardless of cause. All Entry Materials become the exclusive property of Sponsor and will not be returned.
Sponsor reserves the right to cancel or modify this Contest and Project REV at any time with or without notice or if fraud, misconduct or technical failures destroy the integrity of the Project or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by Sponsor in its sole discretion. In the event of termination of the Project, a notice will be posted online.
By participating in this Contest and accepting a Prize award, Entrants agree to release and hold the Sponsor, its subsidiaries, affiliates, agents, Promotional Participant, and its and their officers, directors, employees, agents, and other representatives harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with this Contest including the Sponsor’s use of Entry Materials or the use or misuse of any Prize. This Contest will be governed by the laws of the State of Minnesota and you consent to the exclusive jurisdiction and venue of Minnesota courts, both state and federal, for any disputes arising out of this Contest. Neither Sponsor nor its Promotional Participant is responsible for typographical or other errors in the printing, offering or the announcement of any Prizes or in the administration of the Contest.
